Texas DPS Ending Dallas Tollway Patrols: How arrests happen on the Dallas Tollway

Dallas Tollway Arrest

For years, drivers on the Dallas North Tollway have been familiar with seeing Texas Department of Public Safety (DPS) troopers watching one of the busiest highways in North Texas. From late-night stops after leaving Dallas entertainment districts to morning commutes through Plano and Frisco, Tollway traffic stops have led to thousands of criminal investigations.

Now, a major change is coming.

According to WFAA, the Texas Department of Public Safety notified the North Texas Tollway Authority (NTTA) that DPS will no longer continue its patrol contract after determining the agreement no longer aligned with DPS's statewide mission.

The decision affects major North Texas roads, including:

• Dallas North Tollway
• Chisholm Trail Parkway
• Lewisville Lake Toll Bridge
• Other NTTA-operated roads throughout DFW

While drivers may notice fewer DPS vehicles on these roads, this does not mean criminal enforcement is disappearing.

Police agencies throughout Dallas County, Collin County, Denton County, and Tarrant County can still investigate crimes that begin with traffic stops.

At Texas Defenders, our Dallas criminal defense lawyers have represented people throughout North Texas whose cases started with a simple drive home.

Many people are surprised how quickly a minor traffic stop can become a life-changing criminal accusation.

How a Dallas North Tollway Traffic Stop Can Become a Criminal Case

Most criminal arrests on highways do not begin because an officer already knows a crime occurred.

They often start with something ordinary.

Examples include:

• A vehicle drifting between lanes
• Driving behavior an officer believes indicates impairment
• An accident investigation
• A vehicle stopped late at night leaving a restaurant or bar area
• A conversation where an officer claims to smell alcohol or marijuana

Once a driver is stopped, officers begin looking for signs of possible criminal activity.

What started as a few minutes on the side of the road can quickly turn into:

• A DWI investigation
• A drug possession case
• A firearm-related charge
• An arrest based on an outstanding warrant
• A felony criminal investigation

Dallas North Tollway DWI Arrests

One of the most common criminal charges connected to Tollway stops is Driving While Intoxicated (DWI).

The Dallas North Tollway connects some of the busiest nightlife, restaurant, and entertainment areas in North Texas, including:

• Dallas
• Uptown
• Addison
• Plano
• Frisco

Officers investigating DWI cases frequently mention observations such as:

• The smell of alcohol
• Bloodshot eyes
• Slurred speech
• Admission to drinking
• Performance on field sobriety tests

However, these observations do not automatically mean someone was legally intoxicated.

A person can be tired, nervous, distracted, or dealing with medical issues and still appear suspicious to an officer.

An arrest is only the beginning of the case — not the end.

What Happens During a DWI Investigation?

After a driver is stopped, the officer may start asking questions designed to build evidence.

Common questions include:

“Where are you coming from?”

“Have you been drinking?”

“How many drinks have you had?”

The officer may then request:

• Standardized field sobriety tests
• A breath test
• A blood test

DWI cases often involve complicated legal and scientific issues.

An experienced criminal defense attorney will review questions such as:

• Was the original stop legal?
• Did the officer have enough evidence to continue the investigation?
• Were the tests administered properly?
• Was blood evidence collected and stored correctly?

Drug Charges After Dallas Tollway Stops

Another common result of highway stops is a drug possession arrest.

Many people charged with drug crimes were not originally stopped because of drugs.

Instead, an officer may claim something happened during the stop that justified further investigation.

Examples include:

• Claiming to smell marijuana
• Asking for permission to search the vehicle
• Finding THC products or vape cartridges
• Discovering prescription medication
• Finding alleged controlled substances belonging to a passenger

Drug cases can range from misdemeanors to serious felony charges.

Common cases include:

• Possession of Marijuana
• Possession of a Controlled Substance
• THC concentrate charges
• Prescription drug offenses

These cases are especially common in Dallas County and Collin County because thousands of drivers travel through multiple cities every day.

THC Vape and Marijuana Arrests in North Texas

Many drivers are surprised to learn that marijuana laws in Texas are different from many other states.

A product purchased legally somewhere else can potentially create a criminal case in Texas.

THC vape cartridges, concentrates, and certain cannabis products may result in felony allegations depending on the facts of the case.

Drivers traveling through Dallas, Plano, Frisco, and surrounding areas should understand that Texas drug laws can still carry serious consequences.

Weapons Charges After Traffic Stops

Traffic stops can also lead to firearm-related investigations.

Although Texas allows many people to legally possess firearms, certain circumstances can create criminal allegations.

Weapon cases may involve:

• Allegations involving alcohol or intoxication
• Questions about legal possession
• Other criminal accusations connected to the stop

These cases require a careful review of the facts and applicable Texas law.

Warrants Discovered During Traffic Stops

Some people are arrested during a Tollway stop for something completely unrelated to their driving.

When officers check a person's information, they may discover an outstanding warrant.

These may involve:

• A missed court date
• An unresolved criminal case
• A probation issue
• A previous allegation the person thought was handled

A simple encounter can unexpectedly become an arrest.

Does DPS Leaving NTTA Mean Fewer Criminal Cases?

Not necessarily.

Although DPS ending its Tollway patrol agreement is a major change, North Texas drivers should not assume enforcement is ending.

Other law enforcement agencies may continue responding and conducting investigations along the Dallas North Tollway corridor.

The agency name on the patrol vehicle may change, but DWI arrests, drug investigations, and criminal cases will continue.
