One recent Texas Defenders case illustrates exactly why thorough criminal defense matters.

A mother was accused of Injury to a Child after school personnel believed discoloration on her four-year-old daughter's face was bruising.

The accusation triggered police and CPS involvement, and a bond condition ultimately separated the mother from her young daughter for 21 days.

But the evidence told a very different story.

Texas Defenders obtained and reviewed medical records showing no facial bruising. The child had been diagnosed with an upper respiratory infection and had discoloration underneath the eyes consistent with allergic shiners. Photographs were also consistent with butterfly face paint the child had received at a local festival.

CPS ultimately issued a “Ruled Out” disposition.

Our team first fought to eliminate the no-contact condition so mother and daughter could be reunited.

Then we assembled the medical evidence, CPS findings, photographs and other documentation addressing the allegation itself.

After reviewing the evidence and communicating with CPS, prosecutors rejected the case before it reached a grand jury.

The charge was dismissed.
