Facing a PCS Charge for Mushrooms in Texas? Here’s What You Need to Know

Here's What You Need to Know

Controlled Substance

In Texas, drug laws are among the toughest in the nation, and psilocybin mushrooms (often called “magic mushrooms”) are classified as a controlled substance. If you are caught with mushrooms in Dallas, Fort Worth, McKinney, Plano, Denton, or any surrounding city, you could be facing a PCS (Possession of a Controlled Substance) charge with severe consequences.

At Texas Defenders, we understand how overwhelming it is to be arrested for something like mushrooms, mushroom chocolate bars, or other infused products. Below we'll explain how the law treats these cases, what penalties you might face, and how an experienced criminal defense lawyer can fight for your future.

How Texas Classifies Psilocybin Mushrooms

Psilocybin is the psychoactive compound found in mushrooms, and under the Texas Health and Safety Code, it's classified in Penalty Group 2. This category covers substances considered to have hallucinogenic effects, like MDMA (ecstasy), PCP, and mescaline.

Because psilocybin is in Penalty Group 2, possession charges are felonies in almost every instance—even for small amounts.

Penalties for Possession of Mushrooms in Texas

The penalties for a PCS charge involving mushrooms depend on the weight of the substance. Importantly, the entire weight of the substance counts—that means if psilocybin is baked into a brownie, melted into a chocolate bar, or infused into candy, the state will weigh the whole edible, not just the active ingredient.

  • Less than 1 gram – State Jail Felony

    • 6 months – 2 years in state jail

    • Fine up to $10,000

  • 1 – 4 grams – Third Degree Felony

    • 2 – 10 years in prison

    • Fine up to $10,000

  • 4 – 400 grams – Second Degree Felony

    • 2 – 20 years in prison

    • Fine up to $10,000

  • Over 400 grams – First Degree Felony

    • 5 – 99 years or life in prison

    • Fine up to $50,000

A single psilocybin chocolate bar can weigh several grams and may automatically push a case into serious felony territory, even if the active ingredient is only a fraction of that weight.

Common Defenses in Mushroom PCS Cases

Every case is unique, but at Texas Defenders, we look for weaknesses that can reduce or dismiss the charges. Possible defenses include:

  • Illegal search and seizure – Were the mushrooms, chocolates, or edibles found during a traffic stop or house search without a valid warrant or probable cause?

  • Constructive possession issues – Were the drugs really yours, or simply in a place where multiple people had access?

  • Lab testing errors – Did the state properly test and weigh the substance, or are there chain-of-custody problems?

  • Diversion or treatment programs – For first-time offenders, alternative programs may be available to avoid a permanent felony conviction.

Why Mushroom PCS Cases Are So Serious in North Texas

Dallas, Tarrant, Collin, and Denton counties all treat mushroom cases very aggressively. Prosecutors in these counties routinely seek felony convictions, and a PCS conviction can follow you for life, affecting:

  • Employment opportunities

  • College admission and financial aid

  • Professional licensing

  • Gun ownership rights

  • Immigration status

That's why you need a defense team that knows the local courts and prosecutors. At Texas Defenders, we fight PCS cases every day in these counties, and we know what strategies work in each courthouse.

Other Types of Mushroom Cases We See

While raw psilocybin mushrooms are the most common, law enforcement increasingly seizes alternative forms, including:

  • Psilocybin chocolate bars – Packaged like candy but containing hallucinogenic mushrooms.

  • Mushroom gummies – Similar to THC edibles but infused with psilocybin.

  • Capsules or powders – Dried mushrooms ground and put into pill form.

  • Teas and drinks – Infusions of psilocybin brewed into liquid form.

All of these products are treated the same under Texas law: if they test positive for psilocybin, they fall into Penalty Group 2 and trigger felony-level PCS charges.
