Overview

This case involved an unlawful search of a vehicle by San Antonio Police Department Bike Patrol officers during a downtown traffic stop for loud music. Officers claimed to have obtained “consent” from a teenage driver to search the vehicle, leading to the discovery of an alleged THC vape pen. However, the search violated both the Fourth Amendment and SAPD's own policies requiring a signed consent form. After Texas Defenders challenged the legality of the stop and the search, the District Attorney's Office agreed the evidence was inadmissible — and the case was dismissed in full.


The Stop & Search

In late September 2024, SAPD Bike Patrol stopped a group of out-of-town teenagers around 7:15 p.m. for playing loud music downtown. The driver, 19 years old, was cited for a minor noise violation while waiting for his father to text over proof of insurance. Officers ordered the group to pull into an alley where 4–5 officers surrounded the vehicle.

Body camera footage revealed:

  • No probable cause or suspicious activity was ever identified.

  • The young driver agreed to a search while visibly intimidated by multiple officers.

  • No SAPD Consent to Search Form (#2091-A) was provided or signed.

  • The officers never informed the driver he had the right to refuse.

  • The vape pen was found after everyone exited the vehicle — disproving claims that it was under or near the Defendant.


SAPD Violated Its Own Procedures

Under SAPD General Manual Procedure 502.09, officers must complete a written “Consent for Search of Private Premises” before conducting any consent-based search. That form was never used. This clear procedural failure alone renders the search invalid under SAPD's rules and supports suppression of any evidence obtained.


Consent Was Not Voluntary Under Law

Texas Defenders cited controlling 5th Circuit case law (including Ruigomez, Phillips, Kelly, Wainwright, and Fike) establishing that valid consent must be voluntary, free from coercion, and informed. Here, the young driver was surrounded by multiple uniformed officers, not advised of his rights, and faced with overwhelming pressure — all factors showing coercion. With no other warrant exception (such as probable cause or plain view) applicable, the search was unconstitutional.


Other Issues That Undermined the Case

  • Discrepancies between officer reports and body cam footage

  • Missing footage from several officers

  • No field or lab testing documentation on the alleged vape pen

  • No proof the Defendant knowingly possessed the item

  • Case remained unfiled for over six months, raising speedy trial concerns


Result

After Texas Defenders filed a suppression motion and highlighted the unlawful search and procedural violations, prosecutors dismissed the case entirely. The evidence was ruled inadmissible, and all charges were dropped.


Conclusion

This dismissal sends a clear message: police cannot ignore constitutional rights or departmental policy simply because they are dealing with young or intimidated drivers. The SAPD's failure to follow its own consent procedures and the coercive nature of the stop made this a textbook example of an unlawful search and seizure. Texas Defenders fought to expose the violations and protect our client from an unjust felony prosecution.
