Overview

Our client—a longtime U.S. Postal Service employee and former corrections officer—was wrongfully charged with Interference with Public Duties after an emotional family emergency at his home. With no criminal history and a clear record of public service, he found himself suddenly accused of a crime while trying to help his own son in crisis.

Background

The incident began when the client's 19-year-old son, who suffers from serious mental health challenges, called 911 during a moment of distress. Unbeknownst to his parents, the son had stopped taking his medication and reported hearing voices telling him to harm himself. When police arrived, the family was already working to calm and comfort him.

Body-worn camera footage from the responding officer captured what truly happened: a father holding and comforting his son, telling him he loved him and that help was on the way. Despite the father's calm demeanor and complete cooperation, the officer abruptly escalated the encounter. Without warning, the officer deployed mace directly into the father's face—while he was still embracing his son—and then falsely claimed the father had threatened him.

Even after the father retreated to rinse his eyes and remained compliant, the officer later returned and arrested him in front of his wife and children.

Defense Strategy

The Texas Defenders team immediately obtained and reviewed all available evidence, including the full 911 recording, dispatch logs, and body-worn camera footage. The discrepancies between the officer's report and the video were glaring. The footage made clear that our client's only intent that evening was to protect and comfort his son—not interfere with law enforcement.

We presented this evidence to prosecutors along with our client's exemplary background as a public servant—highlighting his years of service with the U.S. Postal Service and his prior career in law enforcement.
