Case Overview

Texas Defenders represented a client charged with Driving While Intoxicated (DWI) following a late-night accident in Dallas County. According to the police report, officers responded after a pickup truck left the roadway and became partially submerged in a lake. Officers alleged they found our client seated in the driver's seat with the keys in the ignition and observed signs of intoxication, including bloodshot eyes, slurred speech, an odor of alcohol, and difficulty maintaining balance. The report also alleged that our client declined standardized field sobriety tests and initially refused to provide a breath or blood specimen.

After obtaining a blood warrant, the State alleged our client had a blood alcohol concentration of approximately 0.225—nearly three times the legal limit. Combined with the accident, these allegations made the case significantly more challenging than a typical first-offense DWI and substantially reduced the likelihood of receiving deferred adjudication.

Immediate Challenges

From the outset, Texas Defenders recognized that this would require more than simply accepting the State's initial offer. During negotiations, the prosecutor advised that deferred adjudication was not available since this case involved both a serious accident and such a high alleged blood alcohol concentration.

The State's initial plea offer included 24 months of probation, a $4000 fine, mandatory ignition interlock, DWI education classes, a Victim Impact Panel, a Substance Abuse Evaluation, and numerous additional probation conditions. While jail time was probated, the proposed resolution still carried significant financial costs and long-term consequences.

Building the Strongest Possible Mitigation

Rather than waiting for a court date, Texas Defenders immediately began building a comprehensive mitigation package designed to demonstrate that our client deserved an opportunity to avoid a conviction.

We advised our client to proactively complete many of the rehabilitative requirements before negotiations were finalized, including:

  • DWI Education Course

  • Victim Impact Panel

  • Substance Abuse Evaluation

Completing these requirements before entering a plea demonstrated accountability, rehabilitation, and a genuine commitment to ensuring the incident would not happen again.

At the same time, we carefully reviewed the discovery and met directly with the assigned prosecutor to discuss the strengths and weaknesses of the case. We emphasized our client's clean criminal history, personal background, maturity, and the fact that this was an isolated incident rather than a pattern of criminal conduct.

Negotiating a Better Resolution

Texas Defenders continued advocating for a more favorable outcome despite the prosecutor's initial reluctance to offer deferred adjudication.

Through persistent negotiations and by presenting the mitigation package our client had completed, we successfully persuaded the State to make an exception and resolve the case through deferred adjudication.

Our work did not stop there.

Because our client resided outside of Texas, we coordinated directly with the prosecutor, probation department, and the court to obtain approval for non-reporting, mail-in probation, allowing our client to complete probation without regularly reporting in person. We also successfully negotiated the removal of the mandatory ignition interlock requirement and secured a resolution with no fine, substantially improving the terms of probation.

The Outcome

Instead of leaving court with a permanent DWI conviction, our client received one of the best outcomes available under the circumstances.

The case was resolved through deferred adjudication, meaning the judge did not enter a finding of guilt. Instead, our client was placed on probation with specific conditions to complete.

If all terms of probation are successfully completed, the charge will be dismissed by the court without a criminal conviction. While the arrest record and court records may still exist, avoiding a DWI conviction can make a significant difference when applying for jobs, professional licenses, housing, and other opportunities that involve criminal background checks.

In addition to securing deferred adjudication, Texas Defenders negotiated several other important improvements to the plea agreement:
