Case Dismissed: Aggravated Assault with a Deadly Weapon (High-Profile Dallas Shooting)
The Charge
Our firm represented E.H., a Dallas man wrongfully charged with Aggravated Assault with a Deadly Weapon following a highly publicized neighborhood shooting. From the outset, law enforcement treated E.H. as the shooter—despite a lack of physical evidence tying him to firing a weapon.

The Problem: Evidence Withheld & a Flawed Investigation

Hidden Gunshot Residue (GSR) Evidence
Through persistent discovery litigation, Texas Defenders uncovered that a GSR test had been conducted on E.H.—and the results were never disclosed. This evidence was critical. When finally produced, it showed no gunshot residue, directly contradicting the State's theory that our client fired a weapon. -
Detective Credibility Issues
Our investigation also revealed that the lead detective assigned to the case had a documented history of losing or mishandling evidence in prior cases. This called into question the integrity of the entire investigation and the reliability of the State's evidence handling. -
Tunnel Vision Policing
Rather than follow the evidence, the investigation appeared to focus on fitting facts into a predetermined conclusion. Alternative explanations and exculpatory facts were ignored.
